[Adra] The CNT calls off the Strike of Garbage Collecters and Cleaning after Coming to An Agreement with the Municipality

The agreement was subject to the approval of an assembly of the workers, who ratified it.

The Union of Public Services of the CNT Adra informs that last Friday, the 26 of July, the Strike Committee and the Municipality of Adra reached an agreement which allowed them to call off the indefinite strike which was called from 23:00 on July 29.

This agreement was subject to the approval of the workers, which ratified it on Friday by a majority. With the agreement, the Municipality agreed to assume the employment of allt he workers that currently provide the cleaning and garbage collection services, respecting their seniority, both to those who had the guarantee due to technical and administrative conditions, as well as those who had a working relationship with CESPA, except for the administrative personal of 2 people who will remain in the company until the end of the administrative concession and for those from CESPA, in a point of the negotiation to ensure the continuation later, leaving this question in the air.

Valoración de las consecuencias para los trabajadores del fin de la ultraactividad de los convenios colectivos

La reforma laboral de 2012 introduce en el Art. 86.3 del Estatuto de los Trabajadores una modificación sustancial del régimen jurídico de la prórroga o ultraactividad del convenio colectivo hasta entonces vigente.

La nueva redacción establece que desde la denuncia(1) de un convenio colectivo estatutario, éste sólo mantendrá su vigencia como máximo un año, salvo que el propio convenio tenga una cláusula específica que establezca lo contrario, además de la introducción de un arbitraje obligatorio(2) para la solución de discrepancias una vez agotado el proceso negociador.

El preacuerdo para la comisión de seguimiento del II Acuerdo para el empleo y la negociación colectiva (AENC) sobre ultraactividad de los convenios colectivos, firmado el pasado 21 de mayo por CEOE, CEPYME, CCOO Y UGT, señalaba la posibilidad de alcanzar acuerdos específicos sobre la prórroga, incluso durante la fase de negociación del nuevo convenio. Esto ocurriría cuando una de las partes, sindicatos o empresa, decida que la negociación está agotada acudiendo al arbitraje, cuyo laudo tendrá la misma eficacia jurídica que un convenio colectivo. Dicho esto nos podemos encontrar convenios que se hayan prorrogado más allá del 7 de julio pero que finalmente se someterán a arbitraje.

Assessment of the Consequences of the End of the Extended Validity of Collective Agreements for the Workers

The labor reform of 2012 introduced a substanial modification of Article 86.3 of the Workers Statute related to the legal system for extending collective agreements in force until then.

The new wording states that when a statutory collective agreement is legally challenged (1), it will remain in effect for no more than one year, unless the agreement itself has a specific provision to the contrary, and the introduction of compulsory arbitration (2) for the settlement of conflicts once the negotiation process has been exhausted.

The preliminary agreement for the Monitoring Commission of the 2nd Agreement for Employment and Collective Bargaining on the extension of collective agreements, signed on May 21 by CEOE, CEPYME, CCOO and UGT, signalled the possibility of reaching specific agreements on extension, including during the negotiating stage of the new agreement. This would occur when one of the parties, the unions or the company, decides that the negotiation has been exhausted, resorting to arbitration, the decision of which would have the same legal effect as a collective agreement. That said, we can find agreements that were extended past July 7 but which finally were submitted to arbitration.

· La plantilla está harta de la incertidumbre creada en el actual proceso de resolución de contrato a CESPA
· El Ayuntamiento que gestionará el servicio no garantiza la totalidad de los puestos de trabajo ni las condiciones laborales ni salariales

Desde el Sindicato de Servicios Públicos de la CNT de Adra queremos informar a la ciudadanía que ante la actual situación de incertidumbre por la que están atravesando los trabajadores y trabajadoras del servicio público de limpieza viaria y recogida de basura del municipio de Adra una vez agotadas todas las vías de diálogo no dejan otra alternativa a la plantilla que la convocatoria de huelga indefinida para el 29 de julio.

[Adra] CNT Calls an Indefinite Strike in the Street Cleaning and Waste Collection Services

· The staff is tired by the uncertainty created in the current process of bargaining the contract with CESPA.
· The City Hall, which will manage the service, does not agree that all the work places, or the same salaries or other working conditions will be maintained.

The Public Services Union of the CNT Adra wants to inform the public of the current situation of uncertainty that the workers in the public service of street cleaning and garbage collection in the municipality of Adra are facing. Since all means of dialogue have been exhausted, the staff is left with no alternative but to call an indefinite strike starting July 29.

CNT-IAA: Bericht vom Solidaritätstag für die Arbeiter/innen bei Capgemini

Infolge des Aufrufs der „Sektion Telekommunikation und Informationsdienste“ der CNT-IAA Madrid zu einem Solidaritätstag für ihre Mitgliedern und die Arbeiter/innen beim IT-Unternehmen Capgemini haben am 17. Mai 2013 mehrere Gewerkschaften und europäische Sektionen der Internationalen Arbeiter/innen-Assoziation verschiedene Aktionen durchgeführt. Es ging darum die Entlassungspläne zu stoppen, mit denen das Management dieses Unternehmens die 370 Arbeiter/innen konfrontiert hatte.

Международный день протеста против "Капджемини"

По призыву мадридской секции работников телекоммуникации и информационных услуг (STSI) CNT-AIT (секции М.А.Т. в Испании), 17 мая был организован день солидарности с работниками фирмы "Капджемини". Различные профсоюзы и европейские секции Международной ассоциации трудящихся провели акции с требованием отменить т.н. временное увольнение (ERE) 370 работников компании.

День солидарности совпал с 24-часовой забастовкой, которую официальные профсоюзы провели в рамках программы намеченных действий (в случае, если фирма не отменит временное увольнение, 23 мая должна начаться бессрочная забастовка). Члены CNT, работающие на "Капджемини", присоединились к 24-часовой забастовке и частичным забастовкам, несмотря на критическое отношение к "официалам" из "Рабочих комиссий", ВСТ и CIS-F, чье соглашательство с администрацией сделало возможным не только временое увольнение в прошлом году, но и все увольнения 2012-2013 годов.

В Мадриде члены межпрофессионального профсоюза CNT-AIT провели информационный пикет у входа в помещения фирмы "Капджемини" в Алькобендасе, раздавая листовки и информируя о забастовке множество собранных штрейкбрехеров. Несмотря на дождь, пикет прошел с начала до конца, и без существеных инцидентов. Он начался в 8 часов утра. Пикет выставили и официальные профсоюзы, прислав для этого своих освобожденных функционеров.

Report of the CNT-AIT´s Day of Solidarity with the Capgemini workers

As the result of the call by the Telecommunications and IT Services section of the CNT-AIT Madrid for a Day of Solidarity with the CNT-affiliated members and the workers of Capgemini, several trade unions and European sections of the IWA organized different actions to stop the redundancy plan that the management of this company presented against 370 workers.

This Day of Solidarity was called as part of the 24h strike that the subsidized unions organized as part of a program that will conclude, if Capgemini does not withdraw the redunancy plan, in an indefinite strike starting the 23rd of May.

The CNT members of this company participated in this 24h strike, as well as in yesterday´s partial strikes, but taking a critical position with the Legal Representation of the Workers (CC.OO, U.G.T. and CIS-F), whose agreements with the company´s management tolerated a previous redunancy plan the past year and the smaller scale firings that have been happening in 2012 and 2013.

In Madrid, SOV members established an informational picket at the company´s facilities in Alcobendas, giving out leaflets and informing the high number of strikebreakers that went to work. In the rain, the action did not have any incidents, starting at 8.00 a.m. and with the presence of the subsidized trade unions members. The SOV Madrid finished this action not feeling satisfied because of the large number of strikebreakers that are not just working against our interests but, also, against theirs.

Crónica de la Jornada de Solidaridad de la CNT-AIT con los trabajadores de Capgemini

Como resultado de la convocatoria de la Sección de Telecomunicaciones y Servicios Informáticos (STSI) de la CNT-AIT de Madrid para una Jornada de Solidaridad con los afiliados y trabajadores de Capgemini hoy viernes 17 de mayo, diversos sindicatos y secciones europeas de la Asociación Internacional de los Trabajadores (AIT) han organizado diferentes acciones con el objetivo de echar atrás el E.R.E. que la Dirección de esta empresa ha presentado contra 370 trabajadores.

Esta Jornada de Solidaridad se ha circunscrito dentro del paro de 24h que los sindicatos subvencionados han organizado dentro de un programa de acciones que desembocará, si Capgemini no retira el E.R.E., en una huelga indefinida a partir del día 23 de mayo. Los afiliados de la CNT que trabajan en esta empresa se han sumado al paro de 24h, como ayer lo hicieron en los paros parciales, desde un punto de vista del todo crítico con la Representación Legal de los Trabajadores (CC.OO., U.G.T. y CIS-F), cuya connivencia con la Dirección de la empresa ha llevado a permitir no sólo el E.R.E. del año pasado, sino también todos los despidos a cuenta gotas que han ido produciéndose a lo largo del 2.012 y 2.013.

La multinacional Alstom pretende despedir a 373 empleados y clausurar 3 plantas en España.

Llamamiento a la solidaridad internacional.

Alstom es una compañía francesa , líder mundial en infraestructuras de generación y transmisión de energía y transporte ferroviario. La firma esta dividida en cinco sectores :sistemas turbo generadores, medio ambiente , servicios , transporte e industria naviera. Alstom está presente en unos 100 países del mundo y en España desde 1989 implicados en los sectores de generación y transmisión de energía y transporte ferroviario en todo el país.
En 2007 Alstom adquiere la compañía española Ecotecnia Energías Renovables S.L.con la patente tecnológica y las plantas de producción y se creándose Alstom wind.

Alstom wind en España está formado por el centro tecnológico global I+D en Barcelona, la planta de turbinas en Buñuel (Navarra) , la planta de calderería de construcción de torres en Coreses (Zamora), dos plantas de componentes eléctricos en As Somozas (A Corunha), y el mantenimiento de parques eólicos.
El 26 de Marzo de 2013 Alstom presenta un plan de reestructuración en España que afecta a 373 empleados de todos los centros de producción en Alstom Wind España y al cierre de tres plantas: las dos fábricas en As Somozas y la de Coreses.
